
Erie County District Attorney John J. Flynn announces that 18-year-old Clifton D. Eutsey of Buffalo was arraigned this morning before Erie County Court Judge Kenneth Case on an indictment charging him with two counts of Criminal Possession of a Weapon in the Second Degree, Class “C” felonies.
It is alleged that on October 24, 2020, at approximately 9:07 p.m., the defendant was driving eastbound on Erskine Avenue when he was stopped by Buffalo Police officers near Suffolk Street. When the officer approached the vehicle, he allegedly observed a handgun in the defendant’s right jacket pocket. The defendant exited the vehicle and a second handgun was allegedly recovered from the defendant’s left jacket pocket.
Eutsey is scheduled to return on Wednesday, February 10, 2021 at 2:30 p.m. for a pre-trial conference. Judge Case set bail at $50,000.
If convicted on all charges, Eutsey faces a maximum of 15 years in prison.
DA Flynn commends the Buffalo Police Department for their work in the investigation.
The case is being prosecuted by Assistant District Attorney Nicholas Bussi of the DA’s Felony Trials Bureau and Chief Danielle N. D’Abate of the DA’s Community Prosecution Unit.
Eutsey currently has another criminal case for allegedly vandalizing his own vehicle in North Buffalo and falsely reporting the incident to his insurance provider in October 2020. The matter remains pending in Buffalo City Court. He is scheduled to return on Monday, March 1, 2021 at 9:30 a.m. for a felony hearing.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
